Rule 3:21-8. Credit for Confinement Pending Sentence and Re-Sentence

(a) The defendant shall receive credit on the term of a custodial sentence for any
time served in custody in jail or in a state hospital between arrest and the imposition of
sentence.

(b) While committed to a residential treatment facility, the defendant shall receive
credit on the term of a custodial sentence for each day during which the defendant
satisfactorily complied with the terms and conditions of Drug Court "special probation"
pursuant to N.J.S.A. 2C:35-14 or Drug Court probation pursuant to N.J.S.A. 2C:45-1. The
court, in determining the number of credits for time spent in a residential treatment facility,
shall consider the recommendations of the treatment provider.
